Spieler v. Mt. Diablo Diablo Unified School District

The Spieler v. Mt. Diablo Consent Decree represents the most sweeping school access settlement to date under the Americans with Disabilities Act. The Consent Decree creates equal access to school buildings, educational programs, and social programs. Mt. Diablo School District has committed $20 million over ten years to ensure equal access for its 5,000 students with disabilities at 55 school sites, enabling all students with disabilities in the Mt. Diablo Unified School District to attend their neighborhood schools. The Consent Decree also reforms the District's special education system, with policies supporting the integration of disabled children into all educational and social programs. Mt. Diablo Unified School District has created three new programs to benefit disabled students: a Model Augmentative Communication Program for children who need assistive technology, a Model Aide Training Program to train classroom aides to assist children with disabilities, and a full-time Parent Liaison to assist parents to navigate the special educational system.

Disability Rights Advocates (DRA) is monitoring compliance by Mount Diablo Unified School District in regards to the settlement. DRA is investigating complaints concerning architectural access barriers experienced by children with mobility disabilities including barriers relating to playground access at Mount Diablo Schools and policy access as required by the Consent Decree. We are not investigating individual cases nor does the Consent Decree include individual special education issues for any specific child. Because we are a small non-profit organization with a very limited legal staff we cannot offer legal advice on cases that we do not accept for litigation. For this purpose, we have compiled a list of referrals for individual cases that you may find helpful:

If you are having problems which you believe are addressed by the Consent Decree, please see the Consent Decree and Implementation Plans for a list of the issues protected under the Consent Decree. Please understand that although you may submit an Intake through our intake process, as a way for us to hear your concerns and evaluate whether there are issues of compliance, there is a Dispute Resolution procedure outlined in the Consent Decree that you must follow regarding complaints about the District's implementation of the Consent Decree.
